These Terms and Conditions ("Terms") govern your access to and use of the MySweetSport application and website located at app.mysweetsport.com (collectively, the "Services") operated by MySweetSport Inc. ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
You must be at least 18 years of age or have the consent of a parent or legal guardian to use our Services. By using the Services, you represent and warrant that you meet this requirement.
To access certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to: (a) use the Services in any way that violates any applicable law or regulation; (b) attempt to gain unauthorized access to any part of the Services; (c) interfere with or disrupt the integrity or performance of the Services; (d) upload or transmit any viruses, malware, or other harmful code; (e) use the Services to harass, abuse, or harm others; (f) reproduce, duplicate, copy, sell, or exploit any portion of the Services without our express written permission.
Certain features of the Services may require a paid subscription. By subscribing, you agree to pay the applicable fees as described at the time of purchase. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). You authorize us to charge your chosen payment method for all applicable fees. Subscriptions automatically renew unless cancelled before the end of the current billing period. Refunds are handled in accordance with applicable law and our refund policy.
The Services and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software) are the exclusive property of MySweetSport Inc. and are protected by Canadian and international copyright, trademark, patent, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our content without our prior written consent.
You may upload, submit, or otherwise make available content through the Services ("User Content"). You retain ownership of your User Content, but by making it available through the Services, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, and display such User Content solely for the purpose of operating and providing the Services. You represent and warrant that you own or have the necessary rights to your User Content and that it does not infringe any third-party rights.
Your use of the Services is also governed by our Privacy Policy, available at app.mysweetsport.com/privacy. By using the Services, you consent to the collection and use of your information as described in our Privacy Policy.
The Services may contain links to or integrate with third-party services (such as Google, Apple, Stripe, and others). We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those services.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYSWEETSPORT INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
You agree to indemnify, defend, and hold harmless MySweetSport Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Services, your User Content, or your violation of these Terms.
We may terminate or suspend your account and access to the Services at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the Province of Quebec, Canada.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of these Terms and, where appropriate, by sending you a notification. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.
